Vape Mail Ban of CBD and Hemp Products and How We Are Moving Forward

As part of the “Consolidated Appropriations Act, 2021,” in the COVID-19 relief bill signed into law last December, Congress amended the Prevent All Cigarette Trafficking (“PACT”) Act to apply to e-cigarettes and all vaping products.

Cannabis vaporizers are captured in the CAA’s broad and vague definition of ENDS, which are defined as “any electronic device that through an aerosolized solution, delivers nicotine, flavor, or any other substance to users inhaling from the device.” Read more about it in our blog post here.

The newly proposed rule essentially adds CBD and hemp vaporizers to the current rule, making business-to-consumer shipments essentially non-existent.

What Can Vape Consumers Do?

For consumers, buying vape products on the internet and having them delivered may become more difficult moving forward. Not only will there be a lack of shipping options, but the cost of shipping these types of products will increase dramatically.

In addition, receiving shipments from online suppliers will require an adult over the age of 21 to be available to accept the package and show an ID to prove they are over the legal age. 

Although this is an inconvenience to online shoppers, these measures are being put in place to make the industry safer. Your best bet is to find a local shop that has vape products you like. Visiting a business with a brick and mortar location will be a far easier and more cost effective way to purchase vapes.
